General: The following agreement is
between Sat Ananda Hayden,
hereafter referred to as Breeder, and
____________________________________________________hereafter known as
Purchaser for the sale and purchase of the purebred dog of the Whippet
breed as follows:

in consideration of an
adoption fee of $_____________ the Breeder transfers in fee simple all
rights, privileges, and responsibilities associated with the ownership
of the dog to Purchaser subject to the conditions set forth below as of
the date specified and represents the entire agreement between Breeder
and Purchaser in an outright sale.
Use of the Dog:
It is agreed between the Breeder and the Purchaser that this dog is
being acquired as a family companion and to be used for tasks
appropriate to its breed such as lure coursing, hobby racing, therapy
dog, or for exhibition at obedience, flyball, and agility as the
Purchaser may desire. We agree that this dog is not purchased for
resale, nor will it be used or trained for activities which are illegal
or for which it is not suited by temperament or structure. Specifically,
it will not be used as a guard or attack dog or to fight with other
animals or in training other animals for these purposes or in commercial
dog racing activities. Purchaser agrees not to use a dog purchased as a
companion for breeding purposes.
Health:
The Breeder warrants the dog to be in good health and substantially free
from parasites (fleas, ticks, worms, etc.) as of the time of sale. The
health record of the dog is included in the sale. Breeder strongly
encourages Purchaser to have the dog seen by a veterinarian of the
Purchaser’s choice within 72 hours of accepting the dog and to follow
said veterinarian’s directions for future care of the dog. If, at any
time during the life of the dog, it develops health problems which in
the opinion of a licensed veterinarian are likely to be of an inherited
nature and unexpected in a dog of that age, and which will interfere
with the dog’s function as a companion, Purchaser agrees to contact
Breeder. Purchaser may return dog (as below) or keep the dog and if
mutually agreed that the problem is likely to be of an inherited nature,
Breeder may rebate up to a maximum of 20% of purchase price, depending
on the age and condition of the dog when the problem is diagnosed.
Right of Return:
Said dog may be returned to Breeder for any reason at any time following
purchase. If returned within one month from purchase and provided that
the dog has not been damaged or altered in any way the Purchaser will
then be entitled to a refund of the original purchase price. Refund
amount will be reduced by 10% of purchase price for each additional
month or fraction that the dog is kept up to 6 months. After 6 months no
refund applies. If on return to Breeder the dog requires veterinary care
or incurs other expenses due to negligence on the part of the Purchaser,
Breeder’s expenses will be deducted from refund amount. However,
regardless of the provisions above, if the dog is voluntarily returned
to Breeder, for any reason, Purchaser is entitled to a refund as
specified above.
Right of Recovery:
In the event that the Purchaser is unable to keep the dog or to provide
an appropriate home in accordance with this agreement, Purchaser agrees
to contact the Breeder. Purchaser may return dog to Breeder, or with the
Breeder’s concurrence, place the dog in a home of their choosing which
is approved by the Breeder. Purchaser will not abandon the dog,
surrender it to a shelter, or without the Breeder’s permission sell or
give the dog away. If dog is found to have been sold or given away
without the Breeder’s permission, Breeder may take legal action to
recover same and original Purchaser of the dog will be responsible for
all expenses incurred.
Registration:
The Breeder certifies
that the dog is registered with the American Kennel Club as a purebred
Whippet and will provide forms for transfer of such registration.
Breeder further certifies that the animals named in the registration are
the actual parents of the purchased dog. This whippet is sold with a
limited registration.
Ownership Responsibilities:
The Purchaser agrees to maintain the dog in a humane environment and
properly socialize, train, and care for it. The Purchaser will maintain
its licensure in accordance with local law. The dog will be kept
substantially free from parasites, and will be maintained on heartworm
preventative medication and inoculated against rabies, distemper,
parvovirus and other communicable diseases as recommended by a qualified
veterinarian. Purchaser understands that as a matter of breed
temperament Whippets will likely kill small animals such as cats and
accepts all responsibility for such an event. Purchaser also understands
that Whippets are likely to run away and must, at all times be confined
to a fenced area or restrained by a leash. The dog will not be allowed
to roam at large.
Spay/Neuter:
As the dog is being sold as a pet, not a breeding animal, the Purchaser
agrees not to breed the dog and to have the dog spayed or neutered after
it reaches 12 months old and before 2 years if a puppy, or within 6
months if an adult. If Breeder discovers that the dog has been used
for breeding purposes that exceed this agreement the Purchaser forfeits
cost of spay and the dog will be recovered by the Breeder. All legal
fees associated with the recovery will be borne by the Purchaser.
Limits of Refunds and Rebates:
In no case will
the total amount returned to the Purchaser exceed the amount paid by the
Purchaser to the Breeder.
